Terms of Service

These Terms of Service ("Terms") are an agreement between you and Orange Stealth, LLC, a Wyoming limited liability company ("OrangeStealth", "we", "us"), governing your use of orangestealth.com and the tools and services offered there (the "Service"). By using the Service you agree to these Terms. If you are using it for an organization, you represent that you are authorized to bind that organization.

1. What we provide

OrangeStealth offers external, passive security assessments and related consulting. Our free check and the External Security Posture Assessment read only public information: public DNS records, public certificate-transparency logs, and an ordinary request to a public web page. They are external and observational. They are not a penetration test, a vulnerability scan of your internal systems, an audit, or a certification, and we describe them plainly as what they are.

2. Authorized use of the checks

You may submit a domain to our checks only if you own it or are authorized to assess it. You agree not to use the Service to probe, attack, or gather information about systems you have no right to test, and not to misuse the Service in any way that is unlawful or that interferes with its operation.

3. Fees and payment

Paid services are priced as shown at the point of purchase. Payment is processed by Stripe; by purchasing you also agree to Stripe's terms. Fees are stated in US dollars and are exclusive of any taxes, which are your responsibility where they apply.

4. Refunds

If you have purchased an assessment and we have not yet begun the work, you may request a full refund by emailing info@orangestealth.com. Once we have begun the work, the fee is non-refundable, because the value is in the research we perform for you.

5. What you get, and what we do not promise

An assessment reports what is visible from the outside at the time we look. It is a point-in-time view of public information. We do not promise that it finds every issue, that your systems are secure, or that acting on it will prevent any particular incident. The Service is provided "as is" and "as available", without warranties of any kind to the extent the law allows.

6. Our content

The research, reports, and writing we publish are owned by OrangeStealth. A report we deliver to you is yours to use inside your own organization. You may not resell or publicly republish our reports or site content as your own.

7. Limitation of liability

To the extent the law allows, OrangeStealth is not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us for the service that gave rise to the claim in the twelve months before it arose.

8. Indemnification

You agree to defend and hold us harmless from claims arising out of your misuse of the Service or your breach of these Terms, including submitting a domain you were not authorized to assess.

9. Changes and termination

We may change the Service or these Terms; we will post the updated Terms here with a new effective date, and your continued use means you accept them. We may suspend or end access that violates these Terms.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules, and the state and federal courts located in Wyoming have jurisdiction over any dispute, unless a different venue is required by law.
